Terms and Conditions – Luminite Skirts

1. General information

The website fustiteculuminite.ro is managed by Fustițe cu Luminite SRL . Accessing and using this site implies acceptance of these Terms and Conditions.

2. Delivery, Exchange and Return

Delivery

  • Delivery is made by express courier, usually within 1–2 business days , within the limit of available stock, via GLS.

  • The shipping cost is 16.9 lei for orders under 400 lei or free for orders over 400 lei.

  • During busy periods or for reasons beyond our control (holidays, weather conditions, transport blockages) the delivery time may be extended; we will try to inform customers as quickly as possible.

  • The risk of loss or damage to the product is transferred to the Buyer upon handing over the product to the courier.

Change

  • Products can be exchanged within 14 calendar days of receipt.

  • To make the exchange, send an email to fustiteculuminite@gmail.com with the order details and the reason for the exchange; we will communicate the steps for the return.

  • The product must be returned in new condition, unworn, unused and with tags intact.

  • Transportation costs for exchange of 30 lei (round trip shipping) are borne by the Buyer, except in situations where the product has confirmed manufacturing defects.

  • According to the legislation (right of withdrawal), you have the right to return the products within 14 calendar days of receipt, without giving a reason.

  • Returned products must be in the same condition as received (unworn, unused, with tags attached). and packaging intact).

  • To initiate the return, contact us at fustiteculuminite@gmail.com ; we will send you the instructions and return address.

  • The refund will be made within 14 days of receiving the return and checking the condition of the product, through the same method used for payment (or another agreed method).

  • The return cost (16.9 lei) is borne by the Buyer, unless the product has a confirmed manufacturing defect — in this case the return cost will be covered by the Seller.

  • We offer a 30-day commercial warranty for manufacturing defects; the remedy procedure (replacement, repair or refund) will be communicated to the customer after the defect has been assessed.

3. Products and prices

  • The products displayed on the site are presented for informational purposes; there may be slight differences in color or detail between the images and the physical product.

  • Prices are expressed in RON and include VAT.

  • Prices and stocks are subject to change; the final price is the one displayed at the time of order confirmation.

4. Orders

  • The order is considered confirmed when you receive the automatic confirmation email.

  • We reserve the right to refuse or cancel the order in justified cases (incorrect data, suspected fraud, obvious price errors). In case of cancellation, you will be informed and any amounts paid will be fully refunded.

5. Liability

  • We make every effort to ensure that the information published on the site (prices, descriptions, images) is accurate and up-to-date. However, errors or technical inconsistencies may occur, which we will correct as soon as they are identified.

  • We make efforts to ensure the continuous operation of the site, but we cannot guarantee uninterrupted access at all times, due to possible technical problems or external factors.

  • Under no circumstances will the Seller be liable for indirect losses (e.g. lost profits, loss of data) caused by the use of the site.

6. Personal data protection (GDPR)

  • The processing of personal data is carried out in accordance with Regulation (EU) 2016/679 (GDPR) .

  • We collect and process only the data necessary for order processing, delivery, billing and communications related to your orders, as well as to improve your experience on the site (with consent, where applicable).

  • Third parties that may receive data for the purpose of providing services: Shopify (e-commerce platform), payment processors, courier companies, Google Analytics and Hotjar (traffic and behavior analysis). Data is not sold or alienated to third parties for commercial purposes.

Neither party will be liable for failure to perform obligations caused by force majeure events (e.g. natural disasters, pandemics, strikes, network blockages, authority decisions) that prevent the performance of contractual obligations.

11. Modification of terms

We reserve the right to update these Terms and Conditions; changes will be posted on the site. The applicable version is the one available on the site at the time of placing the order.

12. Applicable law and dispute resolution

  • The terms are governed by Romanian law.

  • In the event of disputes, an amicable settlement is attempted; if this is not possible, disputes will be resolved by the competent courts in Romania.

  • Buyers can also use the European online dispute resolution (ODR) platform accessible on the official website of the European Commission.
